SurgeX Terms and Conditions

1. About these terms
These Terms and Conditions form the agreement between you and SurgeX trading as SurgeX or SurgeX Fitness ("SurgeX", "we", "us" or "our") when you use our website or purchase or participate in a SurgeX service.

By placing an order, booking a class, joining coaching or accessing a programme, you confirm that you have read and agree to these terms, the Refund and Cancellation Policy, Privacy Policy and Fitness and Health Disclaimer.
2. Eligibility
You must be 18 or over and legally able to enter a contract. Participants under 18 may only be accepted by prior writtenagreement, with parent or guardian consent and suitable supervision and safeguarding arrangements.
3. Our services
The exact inclusions, duration, access period, equipment requirements, support level and price are those shown on the relevant offer page or order confirmation at the time of purchase.
4. Strength + Flow Assessment
The assessment uses the answers you provide to suggest a suitable starting route. It is educational and commercial guidance, not a medical assessment, diagnosis or guarantee that a programme is appropriate for every person. You remain responsible for providing accurate information and completing health screening before participation where required.
5. Health, safety and your responsibilities
6. Bookings and attendance
Class and coaching places are subject to availability. A booking is confirmed when payment is accepted and a confirmation is sent. You are responsible for checking the date, time, time zone, equipment and access instructions.

Arrive or join on time. Late entry may be refused where it would be unsafe or disruptive. Bookings may not be resold. A transfer to another person requires our written approval and completion of the required health and consent documents.
7. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable. You authorise Stripe or another approved payment provider to collect the displayed amount. We do not store full payment-card details.

If a recurring service is offered, the renewal amount, frequency and cancellation method will be shown before purchase.

If an instalment plan is used for a fixed programme, it must be described as a payment plan rather than a cancel-anytime subscription.

We may suspend access after a failed payment while we contact you and attempt to resolve the issue. You remain responsible for charges validly incurred before cancellation.
8. Digital programme access
Digital content is licensed to you personally for private, non-commercial use. Access may be time-limited as stated at purchase. You must not share logins, copy, resell, publish, screen-record or distribute programme materials except where
the law expressly permits.

To receive immediate access during the statutory cancellation period, you may be asked to expressly request immediate supply and acknowledge the effect on your cancellation right. Details are in the Refund and Cancellation Policy.
9. Coaching and programme changes
We may make reasonable changes to session times, coaches, exercise selections, delivery platforms or programme content to improve safety, quality or delivery. We will not materially reduce a paid service without a reasonable remedy, such as an alternative, credit or refund where appropriate.

A named coach may be replaced if unavailable. Coaching does not create a medical, physiotherapy, psychotherapy or dietetic relationship.
10. Cancellations and refunds
Our Refund and Cancellation Policy forms part of these terms. It explains statutory cooling-off rights, digital access, fixed-date classes, session notice periods, cancellations by SurgeX and refund timing. Nothing in these terms removes
rights that cannot legally be excluded.
11. Conduct and community standards
You must treat coaches, staff and participants respectfully. Harassment, discrimination, threats, unsafe behaviour, unauthorised recording, abusive messages, deliberate disruption or misuse of the platform may result in removal or termination. Where reasonable, we will explain the action taken. Serious conduct may lead to immediate removal without a refund for the affected session, subject to your legal rights.
12. Intellectual property
SurgeX names, logos, programme names, videos, PDFs, methods, copy, designs and training materials are owned by or licensed to us. Purchasing a service does not transfer ownership. You receive only the limited personal licence described in these terms.

You may not use SurgeX materials to train paying clients, create competing products, teach a certification, scrape content or use our branding without written permission.
13. Photos, video and testimonials
We will obtain separate consent before using an identifiable participant’s image, video or testimonial for marketing, except for incidental recording clearly notified and lawfully managed at an event. You may decline optional media consent without losing access to the service.
14. Results and no guarantee
Training outcomes differ because of factors including attendance, effort, sleep, nutrition, injury, health, stress and genetics. We do not guarantee a particular result, body composition, race time, income, medical outcome or performance improvement. Any examples or testimonials describe individual experiences and are not promises.
15. Third-party services
The website may use or link to third-party services such as Webflow, Stripe, ActiveCampaign, Zoom, ManyChat or social platforms. Their own terms and privacy policies may also apply. We are not responsible for an unrelated third party’s independent acts, but we remain responsible for our own legal obligations.
16. Availability and events outside reasonable control
We do not guarantee uninterrupted access. We may be delayed by illness, venue closure, internet or platform failure, extreme weather, public emergency or another event outside reasonable control. We will take reasonable steps to provide an alternative, reschedule, extend access or refund the affected part where appropriate.
17. Liability
Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory rights or any other liability that cannot lawfully be limited.

Subject to the previous sentence, we are not responsible for losses that were not reasonably foreseeable when the contract was made, losses caused by inaccurate information or failure to follow safety instructions, or business losses where you purchased as a consumer. Any limitation will apply only to the extent permitted by law and will be interpreted fairly.

You are responsible for your own equipment and training environment. This does not remove our duty to provide services with reasonable care and skill.
18. Suspension and termination
You may cancel in accordance with the Refund and Cancellation Policy. We may suspend or terminate access for serious or repeated breach, fraud, unsafe conduct, abusive behaviour, non-payment or unlawful sharing of content. We will act proportionately and preserve any refund or statutory remedy you are legally entitled to.
19. Complaints
Contact info@surgex.world with your name, order details and the issue. We aim to acknowledge complaints within 5 business days and provide a substantive response within 14 business days. These targets are not a limit on your legal rights.
20. Changes to these terms
We may update these terms for future purchases or to reflect legal, safety or service changes. The version accepted at purchase normally governs that purchase. If a material change affects an ongoing paid service, we will give reasonable notice and any remedy required by law.
21. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the United Kingdom, you also retain any mandatory consumer protections and rights to bring proceedings available where you live.
